Terms of Service

1. What Intake is

Intake ("we", "us") provides a guided client intake service: a structured flow your clients complete, which we compose into a brand brief, together with this marketing site at intake.design and the application at app.intake.design (together, the "Service"). By creating an account or using the Service you agree to these terms. If you use the Service on behalf of a studio or company, you agree on its behalf and confirm you have authority to do so.

2. Your account

You need an account to use the application. Keep your credentials confidential. Activity under your account is your responsibility. You must be at least 16 years old. We may suspend or close accounts that violate these terms or put the Service or other users at risk.

How we handle personal data — yours and your clients' — is governed by our Privacy Policy, which forms part of these terms. It covers what the marketing site and the application each collect, who processes it, and the choices you have.

3. Your content

The material you and your clients submit through an intake flow, including answers, imported portfolio work and uploaded assets, remains yours. You grant us the limited license needed to operate the Service: to store, process, and display that material to you and the people you share it with, and to compose it into briefs. That operating license does not by itself cover using your content to improve Intake's underlying technology — that is a separate, consent-based use described under “Product improvement, and your choices” in our Privacy Policy. We do not claim ownership of your briefs, and we do not use your private client responses to market to anyone.

4. Acceptable use

Don't misuse the Service: no unlawful content, no attempting to breach or probe our security or other users' data, no scraping or reselling the Service, no automated bulk account creation, and no submitting material you don't have the right to use. We may remove content or restrict access where we reasonably believe these rules are being broken.

5. Example briefs

The example briefs published on this site for well-known brands are unofficial demonstrations, authored by us from each brand's public website to show the brief format. They are not affiliated with, commissioned by, or endorsed by the brands named, and all trademarks remain the property of their owners.

6. Plans and billing

The free plan is free. Paid plans, when offered, renew and are billed as described at the point of purchase; you can cancel any time, effective at the end of the current billing period. We may change plan features or pricing with reasonable notice. Changes never apply retroactively to a period you've already paid for.

7. The service is provided "as is"

We work to keep Intake fast, accurate, and available, but the Service, including the suggestions and briefs Intake generates from language-model processing, is provided "as is", without warranties of any kind. Generated content should be reviewed before you rely on it professionally. To the fullest extent permitted by law, our total liability for any claim arising from the Service is limited to the amount you paid us in the twelve months before the claim, and we are not liable for indirect or consequential damages.

8. Ending things

You can stop using Intake and delete your account at any time. We may terminate or suspend access for breach of these terms. On deletion, we remove your content from the live Service within a reasonable period, subject to routine backups that expire on their own schedule. De-identified content already prepared for product improvement is the one exception — it is no longer linked to your account and cannot be pulled back out; see “Retention and deletion” in our Privacy Policy.

9. Changes to these terms

We may update these terms as the Service evolves. If a change is material we'll give notice, on the site or by email, before it takes effect. Continuing to use the Service after a change takes effect means you accept it.
